"« Nous avions un projet d'attentat contre le Bataclan parce que les propriétaires sont juifs ». Cette phrase, glaçante au regard de la prise d'otages et du carnage qui aurait fait ce vendredi "une centaine de morts" selon des sources policières, a été prononcée dans les bureaux de la DCRI, en février 2011. Les services français interrogeaient alors des membres de «Jaish al-Islam», l'Armée de l'Islam, soupçonnées de l'attentat qui a coûté la vie à une étudiante française au Caire en février 2009. Ils panifiaient un attentat en France et avait donc pris pour cible la célèbre salle de spectacle parisienne.
En 2007 et en 2008, le Bataclan avait déjà été sous la menace de groupes plus ou moins radicaux. En cause : la tenue régulière de conférences ou de galas d'organisations juives, notamment le « Magav », une unité de garde-frontières dépendant de la police d'Israel. En décembre 2008, alors qu'une opération de l'armée israélienne a lieu dans la bande de Gaza, les menaces autour du Bataclan se font plus précises. Sur le web, une vidéo montrant un groupe d'une dizaine de jeunes, le visage masqué par des keffiehs, qui menacent les responsables du Bataclan à propos de l'organisation du gala annuel du Magav. A l'époque, Le Parisien y consacre un article sans que cette poignée de militants soit véritablement identifiée. Dans la foulée, ce meeting annuel sera reporté.
Depuis, à chaque fois qu'une organisation juive se réunit au Bataclan, de nombreux commentaires hostiles fleurissent sur le web. Pourtant, ces dernières années, ils semblaient s'être estompés. Néanmoins, la presse israélienne rappelait que le groupe de rock Eagles of Death qui se produisait ce vendredi 13 au soir, avait effectué une tournée en Israël. Le groupe avait alors dû faire face à plusieurs appels au boycott, ce qui ne les avait pas empêché de s'y produire."

"The idea that the recent wave of Palestinian terror is an understandable (albeit reprehensible) response to Israeli actions appears to be gaining currency among liberal Jews. After Peter Beinart propounded a layman’s version of this theory last week in a Los Angeles speech, sociology professor Samuel Heilman dressed it up in academic jargon for a Haaretz op-ed this week. The theory has many problems, and Jonathan Tobin discussed several of them in his post on Tuesday. But I’d like to add one more: It completely fails to explain why other ethnic groups in comparable situations haven’t responded with periodic outbreaks of vicious violence. The fact that this Palestinian response is far from universal argues that it stems not from their “relative deprivation,” to quote Heilman’s learned phrase, but from something specific to Palestinian culture and attitudes.
Heilman defines “relative deprivation” as “the discontent or deprivation people feel when they compare their positions to others around and like them and realize that in comparison to them they have less of what they believe themselves to be entitled than those around them,” and says it “perfectly describe[s] Palestinians under occupation.” Thus far, his argument is uncontroversial. Palestinians undoubtedly do compare themselves to Israel, and this comparison is undoubtedly frustrating. By almost any yardstick – national sovereignty, civil liberties, democracy, economic welfare – Israelis have a better life than Palestinians do.
Where the argument breaks down is his assertion that this frustration naturally leads them to “explode and strike at anything that walks down the Jewish street.” Or as Beinart put it, that “today’s Palestinian terrorism is a monstrous, demented response to Israel’s denial of basic Palestinian rights.” For if that is true, comparable situations elsewhere in the world should have produced comparable outbreaks of violence. And they haven’t.
Take, for instance, Tibet, which has been occupied by China since 1951 – longer than Israel has controlled the West Bank. The occupation certainly hasn’t brought prosperity to Tibet, which has the highest poverty rate in China. Moreover, Beijing has sought to eradicate Tibetan culture and religion, a process that reached its climax when the government asserted the right to choose the next Panchen Lama, the second-highest post in Tibetan Buddhism’s religious hierarchy. Israel, by contrast, scrupulously respects Palestinians’ religious freedom. Finally, there has been such an influx of Han Chinese settlers into Tibet that ethnic Tibetans are now a minority in “greater Tibet,” whereas Palestinians, despite Israel’s much-hyped settlement activity, remain an overwhelming majority in the West Bank.
So by the Heilman/Beinart standard, one would expect Tibetans to respond to their relative deprivation by launching periodic waves of vicious violence against the Chinese. And yet, that hasn’t happened. Instead, there has been a wave of self-immolations, and even those have been few and far between. According to the International Campaign for Tibet, 143 Tibetans have set themselves on fire as an act of protest since February 2009 – a shocking figure, but spread out over almost seven years. By comparison, there have been 65 Palestinian stabbing attacks in the last six weeks alone.
In short, something in Tibet’s culture or leadership caused Tibetans to respond very differently to “relative deprivation” than Palestinians have.
Alternatively, consider the American civil rights movement. American blacks in the mid-20th century undoubtedly suffered relative deprivation. Despite being American citizens, southern blacks were often denied basic rights like the right to vote and subjected to segregated buses, schools, parks and water fountains, and of course, they were also far poorer than whites. Thus by the Heilman/Beinart standard, one would have expected them to respond with periodic waves of vicious violence against American whites.
Yet that didn’t happen. There were occasional violent riots, but there were no mass waves of stabbings, shootings or suicide bombings by blacks. Instead, the civil rights movement opted for nonviolent civil disobedience. Something in mid-20th century American black culture or leadership caused American blacks to respond very differently than Palestinians have.
Nor is it hard to figure out what this “something” is. The Tibetans’ revered spiritual leader, the Dalai Lama, tirelessly preaches nonviolence. Black civil rights leaders, led by Martin Luther King, Jr., also tirelessly preached nonviolence. And these messages were reinforced by other civil-society institutions, first and foremost Tibetan monasteries and black churches.
In contrast, Palestinian culture is steeped in support for violence and loathing for Jews and Israelis, as Daniel Polisar pointed out in a sweeping analysis of Palestinian opinion polls for Mosaic Magazine this month. Palestinian clerics, political officials and media outlets routinely denigrate Jews as “apes and pigs,” glorify terror attacks (see, for instance, here, here and here) and actively incite to violence (see, for instance, here or here). And that’s in the “moderate” Palestinian Authority. Hamas, needless to say, is even worse (like the Gaza cleric who urged young Palestinians to “cut Jews into body parts”).
Relative deprivation may goad people to react, but whether they react constructively or destructively is entirely their own choice. Palestinians could have chosen to emulate U.S. civil rights leaders and respond constructively to their relative deprivation – for instance, by accepting one of Israel’s repeated offers of statehood. That they have chosen instead to respond with repeated outbursts of vicious violence has nothing whatsoever to do with anything Israel has done, and everything to do with their own culture and leadership."

Antoni Macierewicz avait déclaré en 2002 à la radio conservatrice polonaise Radio Maryja, qu'il avait lu les Protocoles des Sages de Sion, un pamphlet antisémite crée par la police du Tsar et qui est censé montrer la domination juive sur l'économie et les médias. Antoni Macierewicz avait reconnu qu'il existait un débat sur l'authenticité du texte tout en ajoutant : "l'expérience montre qu'il existe de tels groupes (ceux décrits dans les Protocoles, Ndlr) dans les cercles juifs", rapporte le Guardian.
Ces propos avaient été très largement critiqués en les militants anti-racistes en Pologne. "Il est très connu pour son côté diviseur et son style radical, qui est enraciné dans le discours identitaire nationaliste de Radio Maryja (une radio catholique conservatrice, Ndlr). La culture politique du parti au pouvoir de droite semble fortement influencée par de tels discours. C'est un moment triste pour la démocratie polonaise et européenne si la promotion des théorie du complot est récompensée par des nominations de haut niveau", estime le politologue Rafal Pankowski, cité par le quotidien britannique. Take, for example, Morocco’s occupation of Western Sahara, a former Spanish colony. In 1979, the UN General Assembly endorsed the view held by activists for self-rule in Western Sahara that the territorial is illegally occupied by Morocco and affirmed the “inalienable right of the people of Western Sahara” to independence. In 2005, the EU called for a resolution to the conflict that would ensure the “self-determination of the people of Western Sahara.”
The Netherlands and Sweden have submitted formal objections to the EU for its policy of allowing Morocco to continue to label products made in Western Sahara as Moroccan. Yet, the EU has issued no labeling guidelines comparable to those it released this week against Israel.
What happened to Europeans’ strict adherence to the letter of international law? The Europeans are similarly lenient regarding goods produced in Chinese-ruled Tibet, Indian-controlled Kashmir and Turkish-occupied northern Cyprus. "The European Union's decision to label Israeli produce from Judea, Samaria, the Golan Heights and Jerusalem could mark the start of something much bigger - but Israel should be able to effectively challenge it if it opts to do so.
International legal expert Professor Eugene Kontorovich of Northwestern University noted that the move is highly discriminatory, given that the EU does not apply to other cases they themselves define as identical. "It is entirely inconsistent with EU policies towards other areas where they do not recognize a country' sovereignty," he said. "For example, in Western Sahara, the EU does not recognize Moroccan sovereignty but insists it is OK to label goods from there 'Made in Morocco.' It also contradicts all decisions of European courts on this issue. And it discriminates against Israel in a manner illegal under the World Trade Organization treaties."
Despite produce from the areas effected only amounting to a small percentage of total Israeli trade with the EU - around $50 milion per year according to officials' estimates - the impact of such a move could still be far-reaching. Indeed, the EU's own envoy to Israel recently said such a move would only be "the beginning" of efforts against Jewish communities. "It creates an atmosphere of delegitimization, and paves the way for further and more severe restrictions, which are surely coming if these measures are not defeated. The goal is to create a legal ghetto for Israel," Kontorovich explained.
However, he predicted that Israel would have a good chance of overturning the decision if the government made efforts to challenge it, and warned against playing down the threat. "Israel has a good chance of limiting or defeating these rules if it actually fights them - not by saying they are bad, but by actually bringing legal challenges in the appropriate fora," he said. "The inconsistency of the EU's rules make them very vulnerable," he added, agreeing with Israeli officials' who brand the decision a double-standard. "But if Israel just decides that is only about settlements, only about a small amount of trade, and not worth fighting for, it will soon face far more serious restrictions"."

The policy carves out a special legal rule for Israel, not only contradicting the European Union’s own official positions on these issues, but also going against rulings of European national courts, and violating basic tenets of the World Trade Organization.
Faced with criticism from both the right and the left in Israel and the United States, the European Union claims its action is merely “technical,” rather than politically motivated or punitive. Yet this is belied by the fact that the measure comes in response to explicitly political demands for labeling by some member states’ foreign ministers, as well as anti-Israel NGOs.
In fact, the labeling controversy must be viewed as just one step in a broader, purposeful and gradual escalation of anti-Israel measures by the European Union. Two years ago, the commission promulgated a regulation that barred spending money on Israeli academic, scientific or cultural projects in the West Bank or Golan Heights. Then the union began refusing to allow imports of certain Israeli agricultural products. Last year, 15 European states issued warnings, alerting people to unspecified legal dangers of interacting with Israeli settlements. These steps, while supposedly motivated by what the European Union sees as Israel’s occupation of territory, have been applied only to Israel, and not to other countries regarded as occupiers in international law, such as Morocco or Turkey.
Having warned about settlement products, the European Union is now labeling them. Diplomats in Brussels and NGOs have made clear that more coercive measures will follow. In this context, labeling is important not in its immediate economic effects but as a highly visible step in a conscious process of building a legal ghetto around Israel, within which a special set of rules applies.
What has largely escaped notice is that the labeling policy violates the European Union’s own express policy on such issues. The commission primarily justifies labeling as a necessary tool to provide consumers with the information that it does not regard the territories “as part of Israel.” However, European Union and national authorities that have addressed the issue have clearly ruled that special labeling is not required in such situations — neither for consumer protection nor to reflect the European Union’s view of the underlying sovereign status of territories.
Thus the European Union allows Morocco — which has extensive trade ties with Europe, but has occupied Western Sahara since 1975, and populated it heavily with settlers — to export products from its occupied territory labeled “Made in Morocco.” When challenged, the commission formally declared that labeling such goods as “made in” Morocco is not misleading, and is consistent with European trade agreements.
Also, European courts have considered the consumer protection rationale specifically in the context of Israeli products, and rejected it. Just last year, the British Supreme Court ruled, in a case involving Ahava beauty products produced in the West Bank, that “there was no basis for saying that the average consumer would be misled” by a “Made in Israel” label. The court held that such labeling was not deceptive as a matter of both British and European Union law.
The problem is not that the European Union fails to live up to its standards in some cases, like that of Morocco. Rather, in these other cases the union explicitly denies the existence of these standards. Such inconsistency is not just hypocrisy. It is a legal violation in its own right. The European Union’s foundational treaties require regulatory “consistency.” And discrimination against trading partners represents a core violation of the General Agreement on Tariffs and Trade and other treaties of the World Trade Organization, as the law professor Avi Bell and I have shown in detail in a recent paper. The union’s labeling guidelines are manifestly discriminatory, as they apply only to Israel.
The World Trade Organization treaties establish the legal framework for international commerce. Under the W.T.O.’s nondiscrimination requirement, it is impermissible to apply trade rules and restrictions to some member countries and not to others. And the W.T.O.’s protections apply not just to a country’s sovereign territory, but also to areas of its “international responsibility,” such as occupied territories. The United States, with international approval, received the benefit of its international trade treaties even in territories it occupied in World War II, as well as in the Panama Canal Zone, where it made no claim of sovereignty. There is nothing novel about a country’s receiving full trade rights for nonsovereign areas under its administration.
The United States has a great deal riding on the integrity of the international trading system. But the European Union labeling threatens to establish a precedent that would allow politicization of the system, undermining United States economic interests in broad and unpredictable ways. Thus it is not surprising that earlier this year, the United States passed a law opposing such European Union measures against Israel.
Making special rules for Israel has the undesired effect of reducing Israel’s incentives to take international law seriously: If the goal posts can be moved, there is less reason to play the game. As a putative role model for international law, the European Union’s greatest weapon is its probity and consistency. By damaging that, it harms its ability to set the global agenda."
